THE IMPORTANCE OF SEARCH USING VISUAL IMAGES

When using the word Technology it often describes knowledge and achievement in the area of practical outcomes. It may centre on some purposeful and practical application or something innovative which can help human needs in a user friendly every day experience . The Internet provided the momentum for innovators and creative people to explore this new phenomenon where the world became closer and seemingly smaller day by day. Thus the significance of technology is judged by its effects on individuals and communities . The development of the Internet in which technology emerges almost every week contributes to changes in cultural , social and economic circumstances. People need to participate in the creation and use of technology and over the years going back to the days of Columbus inventions have played an enormous role in taking us to the present time .
The process of “ locating web – sites using visual images ” was born in the year 2000 before broadband was a commercial reality . The use of sound and rich media were talked of but had not reached a strong commercial level . An application to the Australian Patent office who undertook world wide searches and examination agreed that the method was patentable and granted a Patent to the Inventor who has now assigned use of that Patent to Vuestar .
RIGHTS ASSOCIATED WITH USE OF PATENTED INTELLECTUAL PROPERTY
The exclusive rights given by a patent to its patentee (the patent owner) are granted by the Patents Act 1990 s 13. The patentee is given the exclusive rights to “exploit” the invention protected by the patent and to authorize another person to exploit the invention. * Australian Patents Act is quoted although other PCT conventions apply .
“Exploit” is defined in Schedule 1 of the Act as follows:
Where the invention is a method or process – use the method or process or do any act mentioned in paragraph (a) in respect of a product resulting form such use.
Direct infringement of a patent occurs where a person exploits the patent without the authorization of the patentee. Contributory infringement of a patent occurs where a person supplies a product to another person where use of that product would constitute an infringement of the patent.
Determining where there is patent infringement is a two step process. First, the language of the patent claims is interpreted in light of the specification and drawings in the patent. Second, the interpreted claims are compared with an allegedly infringing device or method. Each element or step of at least one claim must appear in an infringing device or method, respectively, to establish use or infringement.
HOW DO I KNOW I AM USING THE TECHNOLOGY ?
A web site which has been developed by or for a URL addressee/ owner and uses visual images to hyperlink to other pages in which any first or subsequent page provides the contact details of an Organisation would in Legal terms appear to use the steps and methods outlined in a claim of the Patent .
- A search request submitted by a user to a server – side application via a terminal
- The server – side application searching a database in accordance with the search request
- Identified entries being submitted to the terminal as a search results list ( one entry is sufficient ) each containing a hyperlink to a web page
- Whereby each entry of the search results list contains visual content related to the web - page for which the entry contains a hyperlink , the user able to view the visual content , and contact information for an organization is provided as a component of the search results list
